These Terms of Service ("Terms") govern your access to and use of the Site and any services we provide through it (collectively, the "Services"), including information about senior living options, care referrals, consultations, and related resources.
First Class Seniors ("we," "us," or "our") is a referral and advisory service that helps families find appropriate senior living communities, in-home care, and other resources. Our Services are provided at no cost to you. We are compensated by the senior living communities, care providers, or other partners when a referral results in a placement or engagement.
By accessing, browsing, or using the Site or Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
## 1. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms to use the Site or Services. By using the Site, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.
## 2. Description of Services
- We provide informational resources, personalized recommendations, and referrals to third-party senior living communities, in-home care providers, and related services based on the details you share.
- Our Services are advisory only. We do not provide medical advice, diagnose conditions, or guarantee any specific outcome, placement, or quality of care.
- Any referrals are to independent third-party providers over which we have no control. We do not own, operate, or manage these communities or providers.
- Final decisions about placement, contracts, care arrangements, and payments are solely between you (or the senior) and the chosen provider.
## 3. Our Compensation and No Fees to You
- We do not charge families, seniors, or users any fees for our Services.
## 4. User Conduct and Responsibilities
You agree to:
- Use the Site and Services only for lawful purposes and in accordance with these Terms.
- Provide accurate, current, and complete information when submitting inquiries or forms.
- Not misuse the Site (e.g., no scraping, hacking, interfering with functionality, or transmitting viruses/malware).
- Not impersonate others or provide false information.
- Not use the Site to harass, defame, or infringe on others' rights.
We reserve the right to terminate or restrict access for any violation of these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRST CLASS SENIORS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED $100.
## 10. Indemnification
You agree to indemnify, defend, and hold harmless First Class Seniors and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site/Services, violation of these Terms, or infringement of any third-party rights.
## 11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the Site/Services shall be resolved exclusively in the state or federal courts located in Williamson County, Tennessee. You consent to the personal jurisdiction of such courts.
We encourage informal resolution first—contact us before pursuing legal action.
